Acceptable Use Policy
By using our services, you agree to comply with our policies. We expect you to have a basic knowledge of how the Internet functions, the types of uses which are generally acceptable, and the types of uses which are to be avoided. Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses: Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, harassment, fraud, drug dealing, hardcore adult content (legal content allowed on VPS only), and other illegal activities.
AUP - Acceptable Use Policy
Charges
All recurring charges shall be due and payable in advance on the day of the month you signed up on for every month of the year. Invoices or notices of invoices for recurring charges are issued as a courtesy. For credit card billing, all invoices will automatically be charged at the time of invoicing. Non-recurring charges including excess bandwidth usage and overages will be due and payable upon Customer’s receipt of invoice or notice of invoice. Customer is responsible for monitoring transfer or bandwidth consumption and other services provided while maintaining awareness of the applicable charges due. Bandwidth overages are charged at $1 per each GB used over the allowed limit of the package. Bandwidth for VPS packages is monitored at the network interface card while bandwidth for dedicated servers is monitored at the switch port. Bandwidth usage shown in control panels (i.e. Cpanel) is not an accurate number for total data transfer and should not be used to compare with the actual usage.
Consequences of Violation
When RackWire.com becomes aware of an alleged violation of its Acceptable Use Policy, RackWire.com will initiate an investigation. During the investigation RackWire.com may restrict Customer's access in order to prevent further possible unauthorized activity. Depending on the severity of the violation, RackWire.com may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies. If such violation is a criminal offense, RackWire.com will notify the appropriate law enforcement department of such violation. RackWire.com does not issue service credits for any outages incurred through service disablement resulting from Policy violations.

Cancellation / Termination
All cancellation requests must be received via the ticket system by logging into your client area. Cancellations must be made prior to the next billing cycle. Payments made up to the point of cancellation cannot be refunded. RackWire reserves the right to terminate any client or account at it's sole discretion without notice.
Service Level Agreement
RackWire.com offers a 99.999% network uptime Service Level Agreement and service credits will be applied if requested and the following criteria is met (RackWire.com is not responsible for money lost due to downtime).
Data Center SLA
Outage
A network outage is considered to occur if there is 15 minutes or more of continuous downtime due to a network issue. In addition, planned maintenance will not contribute to the consideration of downtime. Downtime due to VPS or dedicated server issues independent of RackWire will not be considered for this Service Level Agreement. RackWireis in no way responsible for data loss or money lost due to loss of data. While we strive to keep all data backed up on a daily basis for emergency use in the event of hardware failure or similar situation, there may be certain conditions or events that could cause problems with our backup process and we urge clients to keep their own backups.
